Short answer
Short answer. Oklahoma's small claims procedure covers suits for money "based on contract or tort" when the amount sought, "exclusive of attorney fees and other court costs, does not exceed Ten Thousand Dollars ($10,000.00)" (12 O.S. § 1751(A)(1)). A car-damage claim within that limit starts with a sworn small claims affidavit filed "with the clerk of the court" (12 O.S. § 1753).

Small claims is a simpler court procedure for smaller money claims, such as unpaid repairs after an Oklahoma City fender-bender. For the insurance side of vehicle damage, see property damage and rental cars.
The current limit: $10,000
The key line for a car-damage claim:
"Actions for the recovery of money based on contract or tort, including subrogation claims, but excluding libel or slander, in which the amount sought to be recovered, exclusive of attorney fees and other court costs, does not exceed Ten Thousand Dollars ($10,000.00)" (12 O.S. § 1751(A)(1)).
Attorney fees and court costs are not counted toward the limit. The Oklahoma County Court Clerk's page gives the same figure: "Small claims suits may be brought for amounts in controversy not exceeding $10,000." OSCN's history note shows § 1751 was last amended by Laws 2024, HB 1611, effective Nov. 1, 2024.

Who can't use small claims
Section 1751(B) bars suits "by any collection agency, collection agent, or assignee of a claim," with a narrow health care exception.

Step 1: The affidavit
A small claims case for money starts with "an affidavit in substantially the following form with the clerk of the court" (12 O.S. § 1753(A)). The form asks for the defendant's address, the amount owed and what it's for, and states that "plaintiff has demanded payment of the sum, but the defendant refused to pay the same."
Two more rules shape the affidavit:
- The jury statement. "A small claims affidavit shall include a statement acknowledging that the plaintiff is disclaiming a right to a trial by jury on the merits of the case" (12 O.S. § 1751(F)). The Oklahoma County form carries that line in capitals.
- Help drafting it. The statute says that "at his request, the clerk of said court shall draft the same for him," and the affidavit "may be presented by the claimant in person or sent to the clerk by mail" (12 O.S. § 1754). The Oklahoma County Court Clerk's page says its staff can't provide "Assistance filling out forms for you," but it posts a blank Small Claims Affidavit and filing examples. Ask the Clerk's office what help it offers.
The Clerk's page lists its main office at 320 Robert S. Kerr Avenue, Room 500, Oklahoma City, 405-713-1705. Confirm with the Clerk before you go. Its filing example says to "have ready any promissory notes, repair estimates or other documents" for the judge. For a car-damage claim, that means estimates, photos, the crash report and insurer letters. See how to get your Oklahoma crash report.

Step 2: Service and the hearing date
Unless the plaintiff asks for the sheriff or another server, "the defendant shall be served by mail." The clerk mails the affidavit and order "by certified mail and request a return receipt from addressee only" (12 O.S. § 1755).
The appearance date "shall not be more than sixty (60) days nor less than ten (10) days from the date of the order," and the order "shall be served upon the defendant at least seven (7) days prior to the date specified" (12 O.S. § 1756).
The Oklahoma County Court Clerk's page says small claims cases "are set for hearing approximately 4 to 6 weeks after filing," and that "The docket will be called at 9 a.m. for small claims." The county form's order says the matter "shall be heard in front of the Small Claims Judge, on the 6th floor of the Oklahoma County Courthouse, 321 Park Avenue." That is where the small claims judge sits, not where you file.
Step 3: The hearing
Section 1761 says small claims actions "shall be tried to the court without a jury, unless the amount of the claim, counterclaim, or setoff exceeds One Thousand Five Hundred Dollars ($1,500.00)." A party who wants a jury in that case, or a court reporter, must notify the clerk in writing "at least two (2) working days before the date set for the defendant's appearance" and deposit "Fifty Dollars ($50.00)." How this fits with the affidavit's jury statement in § 1751(F) is a question for a lawyer.
The hearing "shall be informal with the sole object of dispensing speedy justice between the parties" (12 O.S. § 1761). The Clerk's filing example adds: "The Judge cannot help collect the judgment."

Step 4: What the other side can do
A counterclaim. If the other driver says you caused the damage, they can file "a verified answer" stating a counterclaim or setoff. It must be delivered to the plaintiff in person and filed "not later than seventy-two (72) hours prior to the hour set for the first appearance" (12 O.S. § 1758).
A transfer out of small claims. For a claim of $7,500 or more, "on motion of the defendant, a small claims action shall be transferred from the small claims docket to another docket of the court" (12 O.S. § 1757(B)). For a claim under $7,500, a transfer is "in the discretion of the court" (§ 1757(A)(1)). Either way, the defendant must mail notice at least 48 hours ahead and deposit $50 as the court cost. After a transfer, the plaintiff must file a regular petition "Within twenty (20) days of the date the transfer order is signed" (§ 1757(D)). Under $7,500, if the plaintiff "ultimately prevails in the action so transferred by the defendant, a reasonable attorney fee shall be allowed" (§ 1757(D)(1)). At $7,500 or more, a fee is allowed only "if attorney fees are otherwise allowed by law" (§ 1757(D)(2)). See filing a car accident lawsuit in Oklahoma County.

Filing fees the Clerk posts
The Court Clerk's small claims section says "Filing fees must be paid at the time of filing." As of Oct. 29, 2026, it lists "$58 plus service" for "Indebtedness less than $5,000." and "$225.39 plus service" for "Indebtedness greater than $5,000." The Clerk's 2025 Summary of Court Costs puts a money claim "up to $5,000" at $58.00, so a claim of exactly $5,000 is in the lower tier, and it lists a "Counterclaim or Set-Off Filing Pursuant to 12 O.S. § 1758" at $20.00. The Clerk's 2025 cost summary lists a $10 mailing charge. Fees change, so confirm with the Clerk before filing.

If you were also hurt
If you were injured in the same crash, ask a lawyer before filing a damage-only small claims case. Lawsuits for "injuring personal property" and for "injury to the rights of another, not arising on contract" are in Oklahoma's two-year category (12 O.S. § 95(A)(3)). Common questions
What is the small claims limit in Oklahoma?
$10,000 as of Oct. 29, 2026. Section 1751(A)(1) covers money claims where the amount sought, "exclusive of attorney fees and other court costs, does not exceed Ten Thousand Dollars ($10,000.00)."
Can I sue the other driver in small claims for my car repairs?
Small claims covers money claims "based on contract or tort" up to that limit (12 O.S. § 1751(A)(1)). Whether it fits your claim depends on the facts.
Is there a jury in small claims?
Section 1761 says cases are "tried to the court without a jury, unless the amount of the claim, counterclaim, or setoff exceeds One Thousand Five Hundred Dollars ($1,500.00)." The affidavit must also include a statement "disclaiming a right to a trial by jury on the merits of the case" (12 O.S. § 1751(F)). Ask a lawyer how both apply.
How soon is the hearing in Oklahoma County?
By statute, 10 to 60 days from the date of the order (12 O.S. § 1756). The Clerk's page says cases are set "approximately 4 to 6 weeks after filing."
Can the other driver move my case out of small claims?
Yes, for claims of $7,500 or more, on the defendant's motion with notice and a $50 deposit (12 O.S. § 1757(B)). Under $7,500, it's up to the court (§ 1757(A)).
